Contract content

Article 1: Marriage agreed upon at the earliest possible date; Anna’s inheritance rights to her mother’s estate shall not be affected by the marriage.

Article 2: Duke Charles’s gift to Anna on 1 December 1616, including all his possessions in France, is confirmed: in addition, all maternal rights and inheritance claims are transferred to Anna.

Article 3: Community of property and goods agreed for the married couple: debts incurred before the marriage are excluded; community of property and goods also includes sums of money brought into the marriage by Anna and Heinrich as dowry and donation propter nuptias

Article 4: Extensive provisions regarding the inheritance of the spouses’ property, both in the event that children are born of the marriage and in the event that it remains childless

Article 5: Settlement of debts brought into the marriage, status of joint ownership and community of property in the event of the death of one of the spouses

Article 6: Gains from sales and disposals of movable and immovable property of the spouses shall revert to the joint ownership and community of property

Article 7: Regulates widow’s dower or widow’s property, widow’s residence including furnishings and widow’s trousseau

Article 8: Anna is free to decide whether to take over her husband’s share of the community of property after his death; if she refuses, she shall not be entitled to a refund of the money she brought into the marriage, but shall only receive what she is entitled to by inheritance, gift, etc.

Article 9: Rights of Henry’s heirs and Anna’s lifelong usufruct of widow’s property regulated

Article 10: Inheritance of Anna’s Lorraine title to the second son born of the marriage regulated; provision in the event of the death of this second son

Article 11: Express consent of the King of France and the Archdukes of Austria declared

Article 12: Obtaining the consent of the Duke of Savoy regulated
